Fixer to Fabulous stars Dave Marrs and Jenny Marrs reached a settlement after their companies Jupiter Rentals and Marrs Construction were sued for breach of contract and warranty.
Closer explains what led up to the legal drama and how the parties reached an agreement before trial, marking an end to the saga as their much-beloved show airs on HGTV.
Marrs Construction and Jupiter Rentals Were Hit With a Lawsuit in 2023
Plaintiffs Matthew McGrath and Sarah McGrath filed a complaint against the Fixer to Fabulous hosts’ companies nearly two years ago, claiming the defendants failed to complete upgrades to their $559,000 property pertaining to their cabinet hardware, broken windows and hardwood floors in the kitchen.
They were seeking the court’s judgment against the companies as well as the costs of litigation to be covered.
“As of August 28, 2022, not a single item on the list of repairs had been performed,” the legal filing alleged. “Since that time, the defendants by and through Dave Marrs have attempted some of the repairs listed, but … several of the attempts to repair have caused more damage to the house.”
Dave and Jenny denied the claims in their response to the court, alleging that the McGraths refused to allow their companies’ agents or subcontractors onto the property.
The Court Ordered Mediation Months After the Lawsuit Was Filed
Despite prior attempts to reach an agreement, a filing from the plaintiffs claimed they did a court ordered mediation on September 19, 2023, but “failed utterly,” according to 5NEWS. The report noted that Dave and Jenny felt the McGraths mischaracterized what happened between them.
Nearly two dozen code violations were disclosed in a March 2024 filing after contractors inspected the McGrath’s house and offered their assessment.
Dave said in an August 2024 deposition that he did not agree with contractors’ opinions on what needed to be fixed.
The Trial Was Pushed Back Before Their Settlement
The trial was originally set to take place in September 2024 but was postponed partly due to weather issues in Benton County, Arkansas.
Jenny and Dave were gearing up for trial on January 27 but a new report from the outlet revealed the parties officially reached a settlement just days before they were due to appear in court, on January 24.
“Come now plaintiffs, Matthew and Sarah McGrath, and defendants, Marrs Construction, Inc. and Jupiter Rentals, LLC, by and through their respective attorneys, and stipulate that all pending claims which are now or may be asserted by any party have been fully compromised by settlement, and upon consummation of settlement, the pending claims in the above-styled lawsuit will be dismissed with prejudice,” a statement in their latest legal filing read.
When Did Dave and Jenny First Appear on HGTV?
Dave and Jenny made their HGTV debut in October 2019, following the couple as they “bring old houses back to life” by giving the properties much-needed restorations.
The show is currently in its seventh season, which premiered in January 2025.
Per the show description, “Throughout the 16 new episodes, the Marrs will rely on Dave’s construction and woodworking expertise and Jenny’s flair for design to deliver impactful transformations for families in their hometown of Bentonville, Arkansas.”
