‘Small man came out on top’ as hundreds MORE to qualify for new €242 cash after grieving dad’s ‘bittersweet’ court win
A GRIEVING dad who took on the State over the Widower’s Pension and won told us: “It’s nice the small man came out on top!”
Dad-of-three John O’Meara was left furious after his application for the pension was turned down because he was not married to his late partner of 20 years Michelle.


John took his fight all the way to the Supreme Court and beat the State with the judge’s ruling forcing the Government to change the law.
Social Protection Minister Dara Calleary this week got Cabinet approval to draft legislation that changes the Widow’s Pension to the Bereaved Partner’s Pension so that people who were not married can apply for the payment.
Speaking to The Irish Sun on Sunday, John told of the difficult decision his family made to go up against the State in their fight against discrimination.
He said: “It was definitely something I didn’t want to do. I had to discuss it with the children and they were all for it.
“A lot of it was for them as well but they couldn’t understand why, you know, we had to fight for it.
“I personally felt we were treated differently as a family. Michelle and myself had both worked all our lives, we paid our contributions.
“And for the kids because they were being discriminated against.”
John’s partner Michelle Batey died in 2021 from cancer.
He said: “When she got cancer it was a big shock for us as a family.”
The new Bereaved Partner’s Pension means that people who are in “an intimate and committed relationship” for two years where there are children involved or five years with no children will qualify for financial help from the State.
The move to extend the eligibility for the pension payment is expected to cost the State an extra €50million.
John is due to meet with Mr Calleary and wants to thank him for taking speedy action after coming into office.
Speaking about the announcement John said: “It is bittersweet at the end of the day for me because I had to take all the risk with this one while the Government challenged me on it originally.
“But it could have very easily went the other way on it. It has been great news to be fair.
“It is nice to see the small man come out on top!”
WHAT IS THE BEREAVED PARTNER'S PENSION?
THE changes to the Bereaved Partner's Pension will see hundreds more people qualify for the payment.
The bereaved partner will now be able to claim the pension if they lived with their significant other for two years and children are involved.
In the absence of children, couples who lived together for five years prior to the bereavement will qualify.
The pension is paid out in a weekly sum to the partner of the person who has died.
Entitlement is based on claimant or their late spouse’s or civil partner’s social insurance record, but both records can not be combined.
There are different rates of payment based on age and the amount of contributions made.
The current rates are as follows:
- 48 or more contributions €249.50 or €289.30 for those over 66
- 36-47 contributions €245.70 or €283.70 for those over 66
- 24-35 contributions €242.90 or €277 for those over 66
Minister Calleary told how he is “delighted” to have secured approval to publish the Bill and described the step forward as an “important financial safeguard” for those who are grieving.
He said: “The loss of a loved one does not discriminate between those who are married or those that lived together in committed relationships.
“The Supreme Court recognised that such distinction was unequal when it came to the Widower’s Contributory Pension.
“With this legislation, we will ensure that a significant financial support is available to grieving partners equally.
“I would like to acknowledge the O’Meara family whose loss of a mother and partner, lead to the legal challenge that ultimately overturned the law.”
