JOSE MAGALLANES, 42, of Susanville was convicted this week after jury trial.

As you may recall, we last saw Magallanes early December when we convicted him at jury trial for violating a domestic violence restraining order and resisting arrest, upon which he was sentenced to 270 days in the county jail. County jail commitments are served at half time by law so a 270-day sentence equates to 135 actual days. With his presentence credits, he was remanded to serve the remaining time and was released on February 6, 2025.
That same day, hours after being released from jail, Magallanes was again suspected of violating the domestic violence restraining order and upon contact was found to be in possession of methamphetamine and a meth pipe.
The jury this time found Magallanes not guilty of violating the restraining order but did find him guilty of possession of methamphetamine and the pipe.
Thanks to the passage of Prop 36 this past November, meth possession in violation of Health & Safety Code section 11377 is “priorable”. Any person sustaining two or more convictions for controlled substance possession can be arrested for and charged with a felony. Defendants are then forced to make the decision to either go to treatment or go to jail. This makes the second controlled substance possession conviction for Magallanes.
The case was tried by DDA Guy Manchuk and was our third case presented to jury in 2025.
